These Terms of Service ("Terms") govern your access to and use of the Blue Collar OS platform, including AI assistant services, training, integrations, and related tools (collectively, the "Service"). The Service is provided by Spearing.co LLC, a North Carolina limited liability company doing business as Blue Collar OS ("BCOS", "we", "us", or "our").

IMPORTANT: AI technology is experimental and evolving. Your assistant may produce incorrect, incomplete, or unexpected outputs. It may take actions you did not intend. You are solely responsible for supervising your assistant and verifying its work — especially for communications sent to clients, financial transactions, and business-critical decisions.

4. Subscriptions & Payment

4.1 Fees

The Service requires a one-time setup fee and a recurring monthly subscription. AI API usage is billed separately based on actual consumption. Current pricing is available at bluecollaros.com or upon request.

4.2 Money-Back Guarantee

We offer a 30-day 100% money-back guarantee on the setup fee if you are not satisfied. Contact us to request a refund.

4.3 Cancellation

You may cancel your monthly subscription at any time. Upon cancellation, your service will remain active through the end of the current billing period. After that, your instance and associated data may be deleted and cannot be recovered.

4.4 API Usage

AI API costs (e.g., Anthropic, OpenAI) are passed through at cost based on your actual usage. These charges are separate from your monthly subscription and are non-refundable.

Your AI assistant runs on dedicated infrastructure. We do not monitor, log, or access your assistant's conversations or data except as necessary for technical support at your request.

You are responsible for backing up your own data. We do not provide automated backups. Upon cancellation or termination, your data may be permanently deleted.

The Service relies on third-party providers (e.g., Anthropic, OpenAI, Telegram, cloud infrastructure). We are not responsible for:

You retain ownership of your business data, configurations, and content. We retain ownership of the BCOS platform, training materials, templates, and proprietary systems. You may not resell, redistribute, or white-label the Service without written permission.

You agree to defend, indemnify, and hold harmless Blue Collar OS and its owners, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUE COLLAR OS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST BUSINESS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Dispute Resolution

Any dispute arising from these Terms shall be resolved by binding arbitration in Moore County, North Carolina, under the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action. If mandatory consumer protection laws in your jurisdiction prohibit arbitration, disputes shall be resolved in the courts of Moore County, North Carolina.

We reserve the right to suspend or terminate your account at any time for violation of these Terms, non-payment, or abusive behavior. You may terminate your account at any time by contacting us.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.
